Privacy Policy
- When you visit the Kiwee web site, we may gather personal information from you in variety of ways. If you purchase content on the site, will collect your payment information. If you download free content, we may ask you for your e-mail address. We may also pass cookies and collect your IP address in the course of communicating with your browser as you navigate our site. We discuss our information gathering, storage, and usage in greater detail below.
- 2.1 Payment Information. Kiwee provides a number of payment processing options for paid content on its sites. These currently include Premium SMS, credit or debit card, phone, and PayPal. We may add other payment options in the future. Each of these payment options require you to submit your account data, which could include e-mail, mobile number, credit/debit card number, name, country, currency, expiration date, PayPal account ID, and other similar information. This information is required to complete your transaction and deliver your content to you. Payments are typically processed by third party payment processors with whom we do business. These companies are required to keep your account information confidential and to use it only to complete your transaction.
- 2.2 E-Mail Address: . When you download free content, we may ask you for your e-mail address. We use this to send you periodic site updates and alerts. You can opt-out of these communications at any time by simply following the links at the bottom of every e-mail. You should allow 10 business days for your request to be processed. If you opt-in and later decide you would like to be removed from our e-mail list, simply click on the opt-out link or send an e-mail to optout@uk.mypersonalexpression.com. We reserve the right to contact you via e-mail regarding billing, administrative, or legal matters relating to your use of the site, regardless of your opt-out choices.
- 2.3 Contact and Questions: The Service allows you to submit questions, comments, or concerns to us. Kiwee will ask for your e-mail address and your question. We will use the information to respond to your inquiry and may share it internally to improve our service to you. In addition, we may use the information for various business purposes, including, but not limited to, sharing consumer testimonials about the Service. However, your personal information will not be sold to third parties. In addition, when we do use your information, we will not disclose personally identifiable information and will only use demographic information including your geographic location and perhaps your first name.
- 2.4 Surveys, Sweepstakes, Contests, or Drawings: Kiwee at times may offer you a chance to participate in a survey, sweepstakes, contest, or drawing. In order to do so, you may be required to disclose personally identifiable information. You also may be asked to share information about your experience with the Kiwee products. This information may be used in the following ways: (1) to notify you that you have won the sweepstakes, contest, or drawing; (2) to conduct market research studies and reports; (3) to give to companies that co-sponsor the sweepstakes, contest, or drawing with Kiwee; or (4) to send you information about the Kiwee products. The information received in this way may be shared with parties conducting research studies. However, you will not be contacted unless you choose to "opt in", as discussed in greater detail below.
- 2.5 Non-Personal Information: An Internet Protocol ("IP") address is a number that is automatically assigned to your computer whenever you are surfing the Web. Web servers automatically identify your computer by its IP address. When visitors request pages from the Kiwee web site, our servers log the guests' IP addresses. We do not normally link IP addresses to anything personally identifiable, which means that a visitor's session will be logged, but the visitor remains anonymous to us. Kiwee collects IP addresses for the purposes of system administration and to audit the use of the site. We also use IP addresses to collect statistical information to send to our advertisers and for other marketing and promotional purposes.
- 3.1 Our Use of Information: Generally, we use the information you provide to process transactions, deliver you content, and operate the site. We endeavour to collect the minimum necessary to accomplish those purposes.
- 3.2 The AGCM Family: Additionally, AGCM is part of a family of companies that includes AmericanGreetings.com, BlueMountain.com, eGreetings.com, PhotoWorks.com, Webshots.com, Carlton Cards Retail, Inc., Plus Mark, Inc., Gibson, Guildhouse, and Designware, among others. We reserve the right to share personal information with the other companies in our family in order to conduct promotions, offer special premiums, and share databases and equipment. We will NOT share your billing or credit card information with anyone, including our sister companies, without your permission.
- 3.3 Partnership with Microsoft: As a Microsoft Live partner, any personally identifiable information we collect will be jointly owned by Kiwee and Microsoft Corporation. For information about Microsoft Corporation's privacy practices go to the MSN privacy statement.
- 3.4 Third Party Service Providers: We may also retain third party contractors to process electronic transactions, to deliver newsletters or other e-mail, provide storage and backup, or provide other services necessary for the operation and administration of the Kiwee sites. We contractually require these third parties to maintain the confidentiality and security of your personal information, to use it only for the authorized purposes and, not to forward it to any third party. Other than as set forth above, we will not share your personal information with any third party without your permission.
- 3.5 Transfer of Data Outside of the European Union: Personal information collected on the Kiwee sites may be stored and processed in the United States or any other country in which Kiwee or its affiliates, subsidiaries or agents maintain facilities. By using the Kiwee site, you consent to any such transfer of information outside of your country.
- 3.6 Other Information Collectors: This Privacy Policy only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, such as outside links to other sites, different rules may apply to their use or disclosure of the personal information you disclose to them. Since Kiwee does not control the privacy policies of third parties, you are subject to the privacy customs and policies of that third party.
- 3.7 Legal Process: Notwithstanding anything else in this policy, we reserve the right to disclose your personal information to appropriate third-parties if we are required to do so by law or we believe that such action is necessary: (i) to comply with legal process such as a search warrant, subpoena or court order; (ii) to protect the company's rights and property; (iii) To investigate reports of users sending fraudulent, harassing, threatening, or abusive messages; (iv) To protect against misuse or unauthorized use of our site; or (v) during emergencies, such as when we believe someone's physical safety is at risk.

4.1 What Are Cookies? Cookies are small text files or pieces of information that a web site transfers to an individual's hard drive. The cookie assigns you an ID, which allows Kiwee to recognize you when you return to the site. By showing how and when guests use the site, cookies help us see which areas are popular and which are not. Many improvements and updates to the site are based on data such as total number of visitors and pages viewed.

4.2 How Can I Disable Cookies? Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or indicate when a cookie is being sent. However, some parts of the site will not function properly or may be considerably slower if you refuse cookies. For example, without cookies, you will not be able to take full advantage of Kiwee's services, or you may have difficulty filling-out surveys.

4.3 Third Party Cookies: You may occasionally get cookies from other parties when you visit the Kiwee web site. Kiwee does not control these cookies. The use of cookies sent by third-party servers is standard in the Internet industry.
- Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Kiwee cannot ensure or warrant the security of any information you transmit to us or any information provided by our web site. Kiwee will not be liable for disclosures of your personal information due to errors in transmission or unauthorized acts of third parties. However, once we receive your transmission, we do our best to ensure its security on our systems by making reasonable efforts to protect the information.

5.1 Site Security: Kiwee uses a technology called Secure Sockets Layer (SSL), which is the industry standard for secure commerce transactions. SSL encrypts all of your personal information, including your name, address, and credit-card number, so that the information cannot be read as it travels over the Internet. All online transactions involving credit cards or personal information use SSL and are secure.
- In the event that Kiwee Downloads or substantially all of its assets are sold or acquired, the web site and all information collected by the web site may be transferred to the acquiring party. In any such transfer, however, such information will remain subject to any terms and conditions applicable to the web site at the time the information was collected, including the terms of this Privacy Policy.
